This application is for condonation of delay of 59 days in filing

Learned counsel for the applicant submits that the reasons for

the delay and the steps taken to file the second appeal are explained in paragraphs 9 and 10 of the application. He submits that the delay occurred is unintentional and hence, for the reasons stated in the application, delay be condoned.

All the respondents are served. Learned counsel appearing for respondent no. 2 opposes the application on the ground that vague reasons are given in the application and the reasons do not appear to be genuine.

I have perused the application. The reasons for the delay are explained in the application. The reasons appear to be acceptable and justifiable. Hence, for the reasons stated in the application, the delay is condoned and the application is allowed in terms of prayer clause (a).
