This application is filed for seeking permission to delete the name of respondent no.5. It is stated that the respondent no.5 is reported to be dead and no relief is sought agaisnt the said respondent. Thus, the applicant wants to delete the name of respondent no.5 from the array of the respondents. The application is supported by affidavit.
Since the application is formal in nature and supported by affidavit, the same is allowed. The applicant is permitted to delete the name of respondent no.5 from the array of respondents, at the risk of the applicant/appellant. Necessary amendment be carried out.
