This application is filed for seeking permission to delete the name of appellant no.1 – Parvatabai Ramrao Deosarkar. It is stated that during the pendency of the appeal, the said respondent passed away and her legal heirs as appellant no. 2 to 5 are already on record. Thus, the applicant wants to delete the name of appellant no.1 from the array of the appellants. The application is supported by affidavit.
Since the application is formal in nature and supported by affidavit, the same is allowed. The applicant is permitted to delete the name of appellant no.1 from the array of appellants, at the risk of the appellants. Necessary amendment be carried out.
