- Page 236 Exhibit C is a Birth Certificate issued by the Government of Uttar Pradesh, Department of Medical and Health based on which it is sought to be demonstrated that the applicant-accused was borne in Uttar Pradesh and hence a Indian citizen. It is claimed that in this background, the offence under the Passports Act and Foreigners Act cannot be said to be inferred.
- When confronted, the learned APP is handicapped for want of instructions.
- In this background, we direct the DCP Crime, Panvel City Police Station to file an affidavit within a period of four weeks dealing with the investigation on the aforesaid documents.
