On reading of the charge-sheet, I formed a prima facie opinion, that it was only the Applicant, who can be responsible for the death and on this ground, the Application was rejected.

Merely because the trial would consume some time and though the learned counsel for the Applicant is conscious of the nature of accusations and the evidence in the charge-sheet, he vaguely attempt to suggest that the case of the Applicant may fall within Section 304 Part I of IPC, still definitely he would require to undergo sentence of ten years.
By directing the Sessions Judge, Panvel to expedite the trial in Sessions Case No.16 of 2022, the Application is rejected.
