This Appeal is filed challenging the Order dated 3 April 2019 passed by the City Civil Court dismissing Notice of Motion No. 471 of 2019 filed by the Appellant-Plaintiff seeking temporary injunction against the Defendant-Wife to restrain her from circulating, writing or addressing any defamatory content against the Plaintiff.

Plaintiff No.1 and Defendant are married. Several matrimonial disputes, then and are pending between them. One of the grievance of the Defendant-Wife is about closure of Demat Account having Client No. 18421938) and DP ID IN No. 301330 without her consent. It appears that the said Demat Account was with Stock Holding Corporation of India Ltd. which happens to be the employer of Plaintiff No.1-husband. While the Defendan-wife, in her capacity as the alleged customer of Stock Holding Corporation of India Ltd. may have right to enquire about the transactions with the said organisation, DefendantWife is not expected to involve her matrimonial disputes in the correspondence addressed to the said organisation which also happens to be her husband’s employer.

In my view, considering the nature of controversy involved in the suit, the Appeal can be disposed of by directing that the Defendant-Wife shall have an opportunity to pursue her grievance about closure of Demat Account Client No. 18421938) and DP ID IN No. 301330. However, while doing so, she shall not make any allegations with regard to any matrimonial disputes between her and Plaintiff No.1husband. With the above directions, the Appeal is disposed of .
