Heard the learned counsel for the applicant and the learned

This application is preferred seeking pre-arrest bail in connection with C.R. No. 355 of 2023 registered at Jaysingpur police station for the offences punishable under sections 7, 7A and 12 of the Prevention of Corruption Act, 1988.

When the application was listed before the Court on 4^th October, 2023 this Court was persuaded to grant interim bail while directing the applicant to join in the investigation.

The learned counsel for the applicant submits that the applicant has cooperated with the investigation and further custodial interrogation is not warranted.

Having regard to the nature of accusations, further custodial interrogation of the applicant does not seem to be warranted to facilitate investigation. I am, therefore, persuaded to make the order of interim bail absolute.

The order of interim bail dated 4^th October, 2023 is made absolute on the terms and conditions incorporated therein.

In addition, the applicant shall cooperate with the investigation and attend Anti-Corruption Bureau, Kolhapur on 8^th and 9^th November, 2023 in between 10 am to 1 pm and, thereafter, as and when directed.

The applicant shall not tamper with the prosecution evidence and give threat or inducement to first informant, any of the prosecution witnesses or any person acquainted with the facts of the case.

The applicant shall regularly attend the proceedings before the jurisdictional Court.

It is clarified that these prima facie observations are confined to determine entitlement to pre-arrest bail only.
