The learned counsel for the Petitioner states that after examining the subject matter, it is decided that for the Petitioner to succeed in getting parole leave it is necessary to challenge Rule 19 of the Prisons (Bombay Furlough and Parole) Rules, 1959. The learned counsel submits that the petition is premised on wrong proposition and seeks leave to withdraw the petition to file a fresh petition incorporating challenge to the Rule.
