application, three co-accused are granted bail under the
provisions of Section 167 of Cr.P.C.. He, therefore, seeks leave
to withdraw this application with liberty to approach the trial
Court for his release on bail under the provisions of Section
167 of Cr.P.C.. He makes a statement that the application
before the trial Court will not be filed on merits. The
statement is accepted.

3.The Application is allowed to be withdrawn with
liberty to the Applicant to approach the trial Court to move an
application for bail strictly under the provisions of Section 167
of Cr.P.C. and not on merits.
