1.This is an application for anticipatory bail in C.R. No.
I-172 of 2020 registered with Badlapur Police Station for offences
under Sections 420, 465, 467, 468, 471, 474 & 120-B of Indian
Penal Code (for short “IPC”).

2.The First Information Report (for short ‘FIR’) was
registered on 26th December, 2020.

3.The gist of allegations reflected in the FIR is that the
applicant No.1 was working as a driver. The subject vehicle was
registered in the name of brother of complainant, who had expired
on 9th June, 2020. The applicant No.1 had made forged and
fabricated documents and transferred the vehicle in the name of
applicant No.2 Manoj Patil after the death of complainant.

4.The contention of the applicants is that the allegations
are false. The car was purchased for consideration amount of
Rs.70,000/-. The relationship between the applicants and deceased
were cordial. They are distantly related to each other. On
instructions from the applicant No.1, present in the Court
submitted that to show bonafides, the applicants are willing to De-
register the car by cancelling the registration which was executed
in the name of applicant No.2.

5.Learned APP submitted that the investigation is in
progress. Statement of the applicants be recorded as an
undertaking to this Court.

6.In the light of the aforesaid factual aspects, the
applicants need not be subjected to custodial interrogation. The
statement of learned counsel for the applicants made on
instructions from the applicant No.1 is accepted as an undertaking
to this Court. The undertaking may be complied as expeditiously as
possible.

7. Hence, I pass the following order:

ORDER

(i) Anticipatory Bail Application No.250 of 2021 is
allowed;

¶25

(ii) In the event of arrest of the applicants in connection
with in C.R. No. I-172 of 2020 registered with Badlapur
Police Station, the applicants be released on bail on
furnishing P. R. Bond in the sum of Rs.25,000/- each with one
or more sureties in the like amount;

(iii) The applicants shall comply statement/undertaking.

(iv) Anticipatory Bail Application stands disposed of accordingly.
