1. Heard learned C ounsel for the applicant and learned
A PP for S tate. Investigating O fficer is present w ith the record.

2. Prosecution case in brief is that, dem olition squad of
Kalyan-D om bivali M unicipal C orporation w ere to raze the

unauthorised construction m ade by the applicant. The persons
present at the site m anhandled the m em bers of dem olition
squad and prevented them from discharging their official duties.
M r. S alvi, learned C ounsel for the applicant denied the
allegations of m anhandling the public servant and in support of
this subm ission, had produced the video recording. It is
subm itted by the learned Prosecutor on instructions that the
video clips did not show that the applicant had m andhandled
the dem olition squad of Kalyan-D om bivali M unicipal
C orporation. In consideration of this fact, in m y view , custodial
interrogation w ill not further the prosecution case. The
application is allow ed. Hence, the follow ing order :

O R D E R

(i) In the event of arrest of the applicant in C rime No.
100/2021 registered at D om bivli Police S tation, he shall
be released on bail on executing P.R. bond for the sum
of Rs.20,000/- (Rs. Tw enty Thousand only) w ith one or
m ore sureties in the like sum .

(ii) The applicant shall report to the Investigating O fficer
as and w hen called and co-operate in the investigation.

(iii) The applicant shall furnish his perm anent residential
address and contact num ber to the Investigating O fficer
forthw ith.

(iv) The applicant shall not tam per w ith the evidence or
attem pt to influence or contact the com plainant,
w itnesses or any person concerned w ith the case.

hereinabove, shall be construed as expression of opinion for
the purpose of granting bail only and the sam e shall not, in any
w ay, influence the trial in other proceedings.
