No.2879 of 2015. Vide order dated 08.02.2016, it was noted by the Division Bench that under the MEPS Rules, 1981, the qualifcation for Laboratory Assistant was SSC pass and there was no requirement of HSC pass, in the light of the which, the impugned communication was quashed and set aside. It was further observed, that so far as the approval granted to Respondent No.5 therein (Smt. Meena Shivaji Gade), was concerned, the same was subsequent to the Petitioner. It was further noted that though the Petitioner was appointed in the year 2008 as a Laboratory Assistant, the proposal for his approval could not be considered by the Respondent-authorities in view of some litigation pending before the Industrial Court and the School Tribunal, in the light of which, Respondent No.5 came to be appointed in the year 2011. It was further observed that, while appointing Respondent No.5, the Education Ofcer should have kept in view the appointment of the Petitioner and also the record maintained by the Respondent-Institution and then only the question of approval to the services of the Petitioner or Respondent No.5 therein ought to have been considered. In the result, the Division Bench quashed and set aside the impugned communication dated 07.01.2015 granting approval to Respondent No.5 on the post of Laboratory Assistant and directed the Education Ofcer to reconsider the issue of approval
