The caste claim of the petitioner for
‘Chhatri Schedule Tribe’ was invalidated by the Scrutiny
Committee in the year 2007. Writ Petition
No.4366/2007 preferred by the petitioner was
dismissed on 23-11-2009. Special Leave Petition was
also dismissed. Review and Curative Petitions were also
dismissed and thereafter, this Review Petition has been
filed after delay of 9 years and 22 days in filing the
petition.

The ground is that, the petitioner has the
pre-constitutional document in the name of his father,
showing the caste ‘Chhatri’ have now become available
and therefore, the review petition is being preferred.

The documents sought to be produced are
from the public record, which could have been obtained
earlier, which is in his name. We are not satisfied about
the explanation for the delay of 9 years and 22 days.

Hence, Civil Application is dismissed.
