1 Heard the learned counsel appearing for the applicant and the learned APP for the State.

2 The learned counsel (appointed) points out that petitioner Arjun is behind bars since 2003 and as of now, with remission must have completed about 22 years of imprisonment.

3 The learned APP disputes this. He submits that the proposal was forwarded to the State Government and possibility of categorisation as per guidelines issued on 16^th November 1978, 11^th May 1992, 11^th April 2008 and 15^th March 2010 has been deliberated in it. The State Government has to take final decision. He is seeking time to obtain instructions in this respect.

4 As we find that interest of justice can be met with by directing the State Government to expedite final decision on said proposal, we are not inclined to adjourn the matter. Hence, with directions to the Respondent – State to take final decision on categorisation of petition within 10 weeks from the date of communication of this order and with liberty to petitioner to approach again if his grievance subsists even thereafter, we partly allow the writ petition and dispose it of.

5 Order be communicated to prisoner in jail.

6 Criminal Application No.562 of 2018 is also disposed of.
