4] The question whether money received by the appellant - creditor, from its borrower is a tainted money or not or its relevance can be looked into by the learned Special Court at that time. The Court, after hearing the parties can issue further directions as deemed fit in the matter.

5] To facilitate this joint consideration, we set aside the directions to present appellant, who is Respondent No.2 before the learned Trial Court in M.A. No.355/2017, to furnish details in respect of statement of loan amount of respondent No.1 before the Trial Court.

6] We accordingly allow the Appeal partly and dispose it of with no order as to costs.
