It appears from the First Information Reports lodged by the applicant and the non-applicant no.2 on 03.06.2017 and 25.08.2017 respectively, that the non-applicant no.2 had belatedly lodged the complaint against the applicant, merely because the applicant had refused to pay the money, as demanded by the non-applicant no.2. Though the accident had allegedly occurred on 03.06.2017 and the applicant had lodged the report with the Ambazari Police Station on the same day, the non-applicant no.2 appears to have lodged the report more than two-and-a-half months later, alleging therein that the car of the applicant had given a dash to his motorcycle from the rear side, as a result of which he had a fall. It is stated in the affidavit-in-reply filed on behalf of the applicant no.1 that the First Information Report is registered against the applicant on the basis of the report lodged by the non-applicant no.2 on 25.08.2017 and the statements of pan kiosk owner and the persons that were present on the spot at the time of the incident. However, we find from the statements of pan kiosk owner and the other person who claims to have witnessed the accident that the car of the applicant had taken a sharp cut but there is no whisper in the statements that the car of the applicant had given a dash to the
