1] The Notice of Motion taken out by the applicant for restoration of the Notice of Motion (L) No. 556 of 2017 which has been dismissed by the Prothonotary and Senior Master by exercising powers under Rule 986 of the Bombay High Court Original Side Rules. In view of the averments made in the affidavit in support of the Notice of Motion, a case for restoration is made out.
2] Accordingly, Notice of Motion is made absolute in terms of prayer clauses (a) and (c) subject to condition that all the office objections in Notice of Motion (L) No. 556 of 2017 will be removed by the applicant within a period of four weeks from today. If the office objections are not removed within stipulated time, the order of rejection of the Notice of Motion will stand.
