Kailas Shinde, has virtually gone unchallenged in the crossexamination, and therefore, the said needs to be accepted. He, further, deposed that, after giving such information by him, PW1 Santosh Pabale and others came on the spot within ten to fifteen minutes and the thieves then started pelting stones towards the people who gathered there. As per version of this witness, then thieves started running from the spot on motorbike and they started chasing the thieves. This witness further deposed that PW1 Santosh Pabale started chasing the thieves by motorcycle and the motorcycle of those thieves skidded at the Chandni Square. Out of three thieves, two thieves succeeded in fleeing from the spot, but one was nabbed by the people and the police. This witness deposed that the appellant/accused present before the court is the same person, who had disclosed his name as Jitu Rajput. Perusal of cross-examination of this witness goes to show that major portion of evidence of this witness virtually went unchallenged and what was suggested to this witness was that he is deposing a lie that appellant/accused Jitu was nabbed by police and people. This suggestion is denied by PW2 Shrikant Gholap.
