IN THE HIGH COURT OF JUDICATURE AT BOMBAY ORDINARY ORIGINAL CIVIL JURISDICTION NOTICE OF MOTION NO. 179 OF 2017
IN
SUIT NO. 58 OF 2017
Dr Ashok M Bhat…Plaintiff
Versus
JVS Healthcare Pvt Ltd…Defendants
Mr Dhiren Karania, i/b GS Hegde & VA Bhagat, for the Plaintiff.
Ms Nishtha Mohanty, i/b Uerone Johnson, for the Defendants.
CORAM: G.S. PATEL, J DATED: 10th March 2017
PC:-
1.Ms Mohanty states that she has no instructions even as to
filing of a vakalatnama. I can appreciate her predicament. The
Defendants ought to have been here. It is not possible to allow them
to continue in this fashion where they ask Advocates to appear but
do not give them instructions or even a vakalatnama.
2.The Defendants have been served. There is no reply to the
Notice of Motion. It is accordingly made absolute in terms of prayer
clauses (a) and (b) for the reasons mentioned in the ad-interim order
of 27th January 2017. This will be accompanied by an order of costs.
