The order dated 10.1.2017 reads thus:-

Issue notice to the respondents, returnable on 24 January 2017.

In addition to Court notice, the Petitioner is permitted to serve the respondents by private notice and to file an affidavit of service to that effect. The learned AGP waives notice for respondent No. 3.

In Writ Petition No. 5397 of 2016, it is contended that the appointment to the post of Assistant Project Officer (Group-D) from General Category has not been made. If that be so, order of such appointment shall not be issued till further orders.

Learned counsel for the applicant states that if the

MPSC is allowed to declare final result of the examination and recruitment process of Assistant Project Officers and Research Officers Grade "B" conducted by the applicant i.e MPSC and permit the applicant to recommend the names of suitable candidates to the Tribal Development Department of the State of Maharashtra, they will keep one post vacant in case the petitioner succeeds in his petition.

In view of the above statement, MPSC is allowed to fill

in the posts except one post which will be kept vacant in

case, the petitioner succeeds in his petition. It is made clear that the recruitment made by the MPSC will be subject to
