1 Heard the counsel appearing for the applicant and also considered the affidavit in support. The applicant's claim is primarily for unpaid wages for services rendered on the vessel m.v.Malaviya Thirty, interest and out of pocket expenses.

2 In my view, it is a fit case for granting of leave under Section 446 of the Companies Act 1956. Accordingly, application disposed in terms of prayer clause-(a).
