This application is moved for pre-arrest bail by the

applicant/accused in C.R.No.15/17 registered with Jaikheda Police Station for the offences punishable under section 323, 324, 325, 326, 447, 504, 506 r/w 34 of the Indian Penal Code. The offence is registered at the instance of one Lahu Totaram Shinde on 18/01/2017.

It is the case of prosecution that on 16/01/2017 at around 05.30 p.m. the applicant/accused and his son and

nephew went to the farm of the complainant and picked up quarrel and they assaulted the complainant and his son Kiran, when he came to rescue his father. It is the case of prosecution that applicant/accused Gulabrao was holding iron rod at that time. The applicant/accused assaulted the sons of complainant Kiran and Ajit and complainant's wife Vijaya with iron rod. Thereafter the offence was registered against the applicant/accused.

The learned counsel for the applicant/accused submitted that the applicant/accused is 62 years old. He has no criminal antecedents. He further submitted that it is not clear that whether the applicant/accused assaulted the complainant Lahu Shinde or not. His wife Vijaya has sustained simple injuries.

The learned prosecutor on instructions opposed the application. He relies on the complaint and so also the statement of witnesses. He submitted that there is fracture to the hand of the complainant.

Perused the FIR. Perused the statements of Ajit Shinde,

Lahu Shinde and Vijaya Shinde. It appears that the other coaccused Yogesh Bhamare has started assaulting first and he assaulted on the hand of Lahu Shinde. The applicant/accused was also holding iron rod. However, the injury certificate of Vijaya discloses that nature of offence is simple. On instructions of the Investigating Officer it is found that applicant/accused has no criminal antecedents. Hence pre-arrest bail is granted to the applicant/accused on following terms and conditions:

(i) In the event of arrest, the applicant/accused shall be released on bail upon furnishing P.R. Bond in the sum of Rs.20,000/- with one or two solvent sureties in the like amount.

(ii) The applicant/accused shall cooperate with the Investigating Officer and attend the concerned police station on every Monday and Friday between 05.00 p.m. to 07.00 p.m. till filing of the charge-sheet.

(iii) The applicant/accused shall not tamper with the evidence or pressurize the complainant.

(iv) The applicant/accused shall not indulge into any criminal activity.
