The learned Counsel appearing for the
petitioner, on instructions, seeks permission to
withdraw the petition so as to enable the petitioner
to file appeal before the Divisional Commissioner,
Aurangabad Division, Aurangabad.
2.The petition is disposed of as withdrawn
with liberty to file appeal before the appellate
authority. Needless to observe that while
considering the prayer of the petitioner for delay
condonation, the appellate authority to keep in view
the time spent by the petitioner for prosecuting this
petition.
