1Heard the learned counsel for the applicant-
Maharashtra Tourism Development Corporation Limited.
The affidavit in support and the documents annexed
thereto show that the applicant has applied to the
Survey Officer under the Maharashtra Land Revenue
Code,1966 for carrying out survey and measurement of
a land and a sum of Rs.10,12,500/- has been already
deposited by the applicant as survey fees with the
City Survey Officer, City Survey Office at Borivali.

2 If on the basis of the application made by the

applicant to the Survey Officer under the
Maharashtra Land Revenue Code, for carrying out
survey and measurement of the land, the Survey
Officer needs police protection, on an application
being made by the Survey Officer, the concerned
local police station is bound to grant adequate
police protection to the Survey Officer.

3Accordingly, we dispose of the Notice of Motion
by passing the following order:

(I)If the Survey Officer appointed for
carrying out survey in terms of the application
made by the applicant needs police protection,
on an application being made by the Survey
Officer to the Officer Incharge of the
concerned local Police Station, necessary
police protection shall be granted to him for
the purpose of carrying out survey and
measurement;

(II)All concerned to act upon an authenticated
copy of this order.
