The applicant - original accused has been convicted

under Section 302 for causing the death of Salim. The

applicant is now seeking bail.

3. Though there are no eye witnesses to the incident,

prima facie, in our opinion, the circumstantial evidence unerringly points out to the complicity of the applicant in death of Salim. PW 6 Mohd. Saie Abdul Kudus Rayani who is

the brother of the deceased has stated that after he asked the applicant about whereabouts of the deceased, the applicant disappeared. The mobile of the deceased was recovered at the instance of the applicant which is stated by panch witness PW 5 Sham. SIM card of the deceased is discovered at the instance of the applicant which has been stated by PW 15 Raja. There was motive for the applicant to commit the murder. In addition, blood stained Koyta and blood stained clothes were recovered at the instance of the applicant. Looking to all these circumstances which are

against the accused, we are not inclined to grant bail to the applicant, hence, the application for bail is rejected.

It is stated that the applicant is in custody since eight

years. In this view of the matter, hearing of the appeal is
