The issue involved in the present petition was also involved in Writ Petition No.8779 of 2014 along with companion matters, decided by the Aurangabad Bench of this Court on 29.01.2015.

In that view of the matter, since the present petition is covered by the aforesaid judgment, the same is disposed of in the following terms.

I) Clause-14 of the impugned Government Resolution shall not apply to the petitioners for the academic year 2014-15.

The petitioner are entitled for fees reimbursement and all other related benefits based on the earlier Government Circular/policy prior to the said impugned Government Resolution (in respect of students admitted through Central Admission Process and belonging to specified reserved category).

III) It is made clear that we have not considered the arguments canvassed by the learned counsel for respective parties about the powers of the State to frame the policy or otherwise. IV) Accordingly, the writ petition stands disposed of with aforesaid observations and directions. No costs.
