By this petition, which is registered as a public interest litigation, the petitioner challenges the decision of the respondent nos.2 and 3 to abolish the Mangrulpir Sub-Division of the Public Works Department of the Zilla Parishad.

According to the petitioner, as per the policy of the State Government, one more Sub-Division was to be established in Washim district when, at the relevant time, the Sub-Division was located at Mangrulpir. It is stated that in stead of creating an additional Sub-Division at Washim, the respondents have carved out two new Sub-Divisions by abolishing the Mangrulpir SubDivision.

We do not find, on hearing the learned counsel for the parties and on a perusal of the affidavit-in-reply filed on behalf of the respondents, that the abolition of the Mangrulpir Sub-Division and establishment of two new Sub-Divisions in Washim district is against the public interest. It is not the case of the petitioner that the abolition of the Mangrulpir Sub-Division has hampered any construction works or that lesser funds are allotted to the Mangrulpir area. We find that the Government in its wisdom had decided to establish two new Sub-Divisions in Washim by

abolishing the Mangrulpir Sub-Division. There is no reason to interfere with the policy decision, specially when it is not the case of the petitioner that any construction work in Mangrulpir is hampered in view of the decision and/or Mangrulpir is receiving lesser grants or funds for construction works.

In view of the aforesaid, the public interest litigation is disposed of with no order as to costs.
