the respondent No.1.
It would not be necessary to issue notice to the respondent No.2 as the respondent No.2 was not represented by a counsel when the matter was dismissed for want of prosecution on the previous date of hearing.
For the reasons stated in the civil application, the prayer made in the application is granted subject to payment of costs of rupees five hundred in the High Court Bar Library within a period of one week.
If the costs are paid and the writ petition is restored, issue notice to the respondent No.2 for hearing of the writ petition on merits. C.A. stands disposed of.
