We have heard Mr. Abhaykumar Apte, learned counsel appointed for the applicant and the learned APP. The conviction of the applicant is based on the eye witness account as well as the arrest of the applicant at

the scene of the incident itself. In the light of the overwhelming evidence, we are not inclined to suspend the substantive sentence of imprisonment and to release the applicant on bail.
