Appeal is already admitted. Thereafter first bail application was taken before another bench (Coram. M.L. Tahaliyani,J). However, it was not argued for the present appellant-original accused no. 1 for bail and it was withdrawn with liberty. Said request was granted. As such there was no order on merits by the earlier bench on the application for bail of the present applicant.

Heard, rival submissions on the application of the present appellant/applicant. Admittedly, during the trial appellant/applicant was on bail. He was convicted for the

offence punishable under section 306, 498(A) of the Indian Penal Code and was sentence to suffer imprisonment for 7 years. After awarding of the conviction on 26^th November, 2014 he was taken in custody and since then he is in Jail.

It is brought to the notice of the court that there was first dying declaration of the victim women/wife of the appellant/applicant that incident of the burning was accidental and there were no imputations against the present appellant/applicant. However, subsequently it was held by the Trial Court that her statement was given under pressure. Whatever it might be, during the trial appellant was on bail and he has been convicted for 7 years and it will take much time for taking up the appeal for final hearing. Reportedly, other coaccused is on bail. As such, considering the circumstances present application for bail is allowed. Applicant/appellant be released on same bail as granted by trial Court with fresh bond to be executed before Trial Court. Application is disposed of accordingly.
