Learned counsel for the applicant takes exception to order dated 21.06.2014 below Exh.1 in Regular Criminal Case No. 1270/2010, by which the trial Judge refused to issue process against the remaining accused except accused no.1-Pradip.
I have heard learned counsel for the applicant at length so also counsel for non applicants. Upon hearing counsel for the rival parties, I find that so far as grievance made by Mr. Nayyar, learned counsel for the applicant is concerned, the element of mens rea appears to be absent as against non applicant nos. 2 to 4, as they bonafidely purchased the suit plot and there is no even whisper about their role of criminal nature. That being so, I pass the following order.

is rejected.
