However, having regard to the fact that today afternoon may be the last meeting of the Standing Committee before the notification of ensuing elections is issued, the MCGM does not want the decision to be postponed as the entire process of road repair may get unduly delayed. Moreover, it is submitted that the Milling Machine is an essential machine for doing the contract work and only three months will be available before the onset of monsoon for carrying out the work of strengthening and improvement of the roads in Asphalt and Mechanized Mastic Asphalt in the city of Mumbai. No work could be done during the monsoon and it shall recommence only thereafter. The Respondent no.6 already has the required number of Milling Machines, whereas the Petitioners don't have two Milling Machines, as stipulated. As regards the Milling Machine which the Petitioners claim to have purchased, it is stated that the said machine appears to be twenty years old machine, which was sold by M/s.A.R.C. Construction Company Pvt.Ltd. to Nanji Construction Company on 2 February 2009 for a price of Rs.5.72 lakhs and the said Milling Machine was described as “ Scrape – Milling Machine”. It is, therefore, submitted that the condition of the machine must have been such that it was initially described on the invoice as “Scrape Milling Machine” but the word “ Scrape” subsequently scored off. He submitted that the MCGM would not like to get the work done by a milling machine which is more than twenty years old and which was possibly sold as a scrap machine to Nanji Construction Company in the year 2009.
