covering letter dated 21st August 2014. The area of the encroached portion as shown in the map at Exhibit-36 has been shown by washed green colour. The said area is found to be 29 Ares. From the said survey map, it is seen that the area in possession of the second Respondent Panchayat Samiti has been enclosed by a compound which is shown delineated by yellow colour. The area is found to be 20 Ares. Thus, from the said map, it appears that the portion shown delineated by yellow colour is an area acquired which is approximately 20 Ares. From the said map, it appears that a part of the encroached land (totally admeasuring 29 Gunthas) is covered by a road. Thus, the area covered by the road appears to be 9 Ares out of the totally encroached area of 29 Ares. The Petitioner was entitled to possession of the said area of 9 Ares. As the said area is now covered by a road, the Petitioner will not be entitled to the possession of the said area of 9 Ares. However, the Petitioner will have to adopt appropriate proceedings for seeking compensation in respect of the said area of 9 Ares inasmuch as now the road has been constructed thereon. The map drawn by the Deputy Director of the Land Records notes that the Petitioner is in possession of an area of 13.2 Ares out of Survey No.2. The said portion is delineated by the red colour.
