Shahnaz Jahan Saeed and Anr. Vs Union of India, through Joint Secretary, Ministry of External Affairs (Haj Cell) and Ors.

In this petition under Article 226 of the Constitution of India, the petitioners have prayed for three substantive reliefs. Prayers (a) and (c) are in respect of the implementation of the orders passed by the Civil Court, Thane, Maharashtra in Special Civil Suit No.660 of 2009 decided on 27 June 2011 and Special Civil Suit No. 817 of 2008 decided on 11 May 2010.

Prayer (b) is for direction to the Government of India through the Joint Secretary, Ministry of External Affairs (Hajj Cell), New Delhi to decide the petition filed (Exhibit `K' to the petition) after giving an opportunity of personal hearing to the petitioners. That representation was made as far back as on 28 March 2014.

We, therefore, think it appropriate to dispose of the petition with a direction to respondent No.1 to consider and decide the representation dated 28 March 2014 of the petitioners, copy whereof is at Exhibit `K' to this petition. For the sake of convenience, the petitioners shall give a copy of the said representation alongwith any supplementary representation, to respondent No.1 within one week from today and respondent No.1 shall consider and decide the same as expeditiously as possible and preferably within two months from the date of receipt of this order, alongwith a copy of the representation. The petitioners shall also be given an opportunity of personal hearing.
