By this petition, the petitioner has sought a direction to the respondent no.1 management to accommodate the petitioner in one of the two schools run by the management. In the alternative, the petitioner has sought a direction to the Education Officer to declare the petitioner as surplus and absorb the petitioner in some other school.

Shri Khubalkar, the learned Assistant Government Pleader appearing on behalf of the Education Officer, on instructions from the Education Officer, states that an order is passed by the Education Officer on 2.7.2014 accommodating the petitioner in Shri Sonaji Maharaj High School, Sonala, Tah. Sangrampur, District Buldhana. The learned Assistant Government Pleader has placed a copy of the order dated 2.7.2014 on record.

In view of the statement made by the learned Assistant Government pleader, the alternate prayer made by the petitioner stands granted. The petitioner should, therefore, start working in Shri Sonaji Maharaj High School, Sonala, District Buldhana. The petitioner stands absorbed in Shri Sonaji Maharaj High School, Sonala, District Buldhana with continuity of service, in view of the judgment of the Presiding Officer, School Tribunal, Amravati, dated 26.8.2011.

Since the alternate prayer made by the petitioner stands granted, the writ petition is disposed of with no order as to costs.
