1 The petitioner is a fourth year engineering student of Respondent No.1-Jawaharlal Nehru Engineering College, Aurangabad. The petitioner has not cleared his second year and third year examinations. However, in view of Circular issued by the University on 08.08.2013, the petitioner is allowed to take admission to the fourth year engineering course and in view of paragraph no.2 of the said Circular, he is entitled to complete term work for fourth year engineering course. entitled to appear for the examination of fourth year engineering course since he has not cleared the second year examination.

2 Learned Counsel appearing for Respondent No.1University informs that the petitioner would be permitted to complete the term work for the fourth year, however, he is not entitled to appear for examination of fourth year engineering course.

3 In view of the circular dated 08.08.2013, petitioner can be permitted to attend fourth year classes and Respondent-College shall not prohibit the petitioner from attending fourth year classes.

4 With the directions as aforesaid, writ petition stands disposed of.
