1 The petitioner claims to be belonging to 'Thakur' tribe, which is included in Scheduled Tribe category. On the strength of the said certificate issued in favour of the petitioner, certifying that he belongs to Thakur, a Scheduled Tribe, the petitioner has been inducted as Conductor on the establishment of Respondent No.3 as against a post reserved for Scheduled Tribe category.

2 It is informed that proposal in respect of verification of tribe certificate has been referred to the Scrutiny Committee, which is stated to be pending and no decision, as yet, has been arrived at.

3 The petition, as such, can be disposed of by issuing a direction to Respondent No.2-Scrutiny Committee to take decision

on the proposal in respect of verification of tribe certificate issued in favour of the petitioner, as expeditiously as possible, preferably within a period of one year from today.

4 Order accordingly.

5 In the meanwhile, Respondent No.3 is directed not to terminate services of the petitioner only on the ground of his failure to submit validity certificate. It would be open for Respondent No.3 to take appropriate steps in accordance with the decision of Respondent No.2-Committee on the proposal in respect of verification of tribe certificate of the petitioner.

6 With the directions as above, writ petition stands disposed of.
