1]The petitioner makes a grievance that the respondent
no.5, who has been granted licence to excavate sand from

Godawari river is using a part of land belonging to her

being Gut No.8 for transportation of the excavated sand.

¶19

According to petitioner, the respondent no.5 has
encroached upon the property belonging to her and laid
down a way for transportation of sand without seeking her
prior permission. The petitioner has already approached

the Police authorities for redressal of her grievance.

2]It would be open for the petitioner to avail of

remedies available under the ordinary law for redressal
of her grievance. It would also be open for the
petitioner to approach the Collector under the policy
prescribed by the State Government and take appropriate
steps against the contractor for violating the terms of
the policy. If the petitioner tenders such an

application, the same shall be dealt with by the
Collector in accordance with the policy.

3]Keeping the option of the petitioner to avail
alternative remedies for redressal of her grievance open,
the writ petition stands disposed of.
