2]Advocate Shri R.A. Deshmukh invites our attention to
prayer clause (B) of writ petition as also to statement
contained in paragraph no.6 of the affidavit in reply
filed on behalf of respondent no.3 dated 29.4.2011. He
states that in view of the statement made in paragraph
no.6 of said affidavit, the grievance of the petitioner
stands redressed.
3]Said paragraph no.6 reads as under:-
“From the facts as referred above, it would be
clear that the project will be implemented on
changed alignment (through CIDCO Land) and not in
Agriculture land and Defence land.”
4]In view of the statement made by learned counsel for
petitioner, writ petition is disposed of as infructuous.
Rule is discharged. No order as to costs.
