that though a Division Bench of this Court was

pleased to set aside the order passed by the
MPID Court on 3-4-2000 with the direction to

the MPID Court to decide the application filed by the income-tax authorities in accordance with law since the Act was held to be ultra vires by this Court, the matter could not be proceeded with and thereafter now the Supreme Court has set aside the said Judgment of this Court and has upheld the vires of the MPID Act. That being the position, we direct the Designated Court, which is constituted under the provisions of the MPID Act, to decide the application of the petitioner as expeditiously as possible and in any case within a period of twelve weeks from today. We also direct the Designated Court to consider the contention of the petitioner and pass appropriate order on merit and in accordance with law. The petition is disposed of.
