Learned counsel for the petitioner states that in view of written instructions received for withdrawal of the petition, as the respondent-wife has filed pursis before the Family Court at Pune for withdrawal of PB No.16 of 2013, this petition preferred by the petitioner-husband has become infructuous. The learned counsel states that she is making this motion for withdrawal in the presence of Power of Attorney holder of the petitioner-husband. The learned counsel has tendered copy of e-mail and zerox copy of the pursis. The same are taken on record and marked “X” collectively for identification. In view of the above, withdrawal being choice of the parties, the petition is disposed of as withdrawn.
