Pralhad Bapurao Gade and Anr. Vs the State of Maharashtra and Ors.

1] Challenge in this petition is to list of beneficiaries for availing a well under the Employment Guarantee Scheme. That list was prepared on 9.3.2010. This court has on 29.3.2010, directed parties to maintain statusquo in respect of that list.

2] Entitlement of the various other persons may have been considered in subsequent years i.e. for the year 2010-2011 onwards till this year and new list may have been prepared. Some of the beneficiaries in said list dated 9.3.2010, may have availed of well because they figured again in later list. Similarly, two petitioners before this court may have also been found eligible in subsequent years. Definite data in this respect is not available on record. Beneficiaries are not parties before this court.

3] Considering the fact that, beneficiaries are to be extended the benefit of a welfare scheme, we feel it appropriate to direct petitioners to submit proper representation in this respect to respondent No.3 Chief Executive Officer, within 3 weeks from today. Said representation shall point out position as on today. If such representation is received by respondent

No.3 he shall consider it as per law within further six weeks. Interim orders given by this court on 20.3.2010 to continue till final orders on such consideration by respondent No.3.
