Heard learned Counsel for the parties.

The learned Advocate General has referred to paragraph-3 of the additional affidavit filed by the State of Mr. Shivaji Tukaram Dhamankar who is Controller of Accommodation and Under Secretary, General Administration Department, Mantralaya, Mumbai. Learned Advocate General further submits that in accordance with the statement made in the affidavit, the State would take further steps. The learned Advocate General submitted that the proceedings initiated by Collector, Nashik under the provisions of the Bombay Land Requisition Act pursuant to GR dated 20th August, 2014 would stand withdrawn. The State Government would initiate fresh proceedings accordingly.

The learned Counsel appearing for the petitioner submitted that in view of the stand adopted by the State as reflected in the additional affidavit and submissions advanced by the Advocate General, appropriate orders may be passed.

We have perused the additional affidavit filed and considered the submissions advanced. Paragraph-3 of the additional affidavit of Shri Shivaji Dhamankar reads as under:

"I hereby respectfully submit that the Government will take appropriate steps pursuant to Section 8B of the Bombay Land Requisition Act, 1948 and under Notification dated 20/06/1981 which is already placed on record of this Hon'ble Court. All the proceedings and steps under the said Bombay Land Requisition Act, 1948 will be followed including the proceedings under Section 5 and

8 afresh, after giving fair and reasonable opportunity to all concerned. I further say that if it is found necessary, a fresh notification shall be issued. The necessary procedure for fixing compensation under Section 8 shall be followed. If any one is aggrieved by the Order of fixing of the compensation, he has remedy to file appeal under Section 8(3) of the said Act."

In view of the statement made by the learned Advocate General, aforesaid writ petitions are disposed of.
