Heard Mr. Mulgaonkar, learned Counsel appearing on behalf of the petitioners, Mr. V. Rodrigues, learned Additional Government Advocate appearing on behalf of respondent no.1. and Mr. A. Rodrigues, learned Counsel appearing on behalf of respondent no.3.

By this petition, the petitioners have taken exception to the order dated 20/12/2013 passed by respondent no.1 by which the ad interim ex-parte relief in terms of prayer (a) asked for in Municipal Appeal No.MIN(UD)/57/2013 has been granted and the appeal is pending since then.

After hearing the learned Counsel appearing on behalf of the parties, this Court is of the view that the petition can be disposed of by giving appropriate directions to respondent no.1 to dispose of the appeal itself within some prescribed period.

Hence, the petition is disposed of with the following order :

ORDER

(a) Respondent no.1 shall dispose of the appeal within four weeks from today, in accordance with law.

(b) All the contentions of the parties including about

jurisdiction of respondent no.1, are kept open.

¶18

(c) Parties shall not seek adjournments and shall co-operate

¶19

with respondent no.1 for disposal of the proceedings.

The petition stands disposed of accordingly.
