1We have perused the report dated 21st April 2014
signed by the Lt Cdr Shibu Devasia, Chairman of
Aruna Choudhary Madhyamik Vidyalaya. The said
report shows that the school has been shifted to a
new premises. The affidavit filed by the said
Officer is affirmed on 28th April 2014. We accept
the said statements made in the affidavit and
especially paragraphs 3 and 4 thereof. In the
affidavit, it is stated that science and computer
Labs will be made available to the students in the
new premises and that new premises of the school
will be fully functional from the academic year
2014-15.

2The learned counsel for the respondent Nos.1 to

7 on instructions of the respondent No.7 states
that the said respondents have no objection if the
Education Officer (Secondary), Zilla Parishad, Pune
is directed to visit the new premises of the school
and submit a report to this Court on the question
whether a proper infrastructure has been provided
therein.

3 Hence, we pass the following order:

(i)We accept the statements made in the
affidavit of Lt Cdr Shibu Devasia which is
tendered today;

(ii)We direct the Education Officer
(Secondary), Zilla Parishad, Pune to make a
visit to the new school premises after
notice to the respondent Nos.6 to 8;

¶18

(iii)The Education Officer shall visit the
new school premises in the last week of May
2014 and will ascertain whether proper
infrastructure has been provided in the new
premises;

(iv)The Education Officer shall file a
report to this Court along with an
affidavit through the office of the
Government Pleader;

¶20

(v)The Education Officer shall supply a
copy of the report to the Advocate for the
petitioners or to the petitioners;

¶21

(vi)The report shall be submitted by the
Education Officer to this Court along with
an affidavit on or before 13th June 2014;

(vii)In the event, the petitioners find
from the report that proper infrastructure
has not been provided, the petitioners are
free to take out appropriate application in
this disposed of petition;

(viii)Petition is disposed of on above
terms.
