1.Notice of Motion No. 2547 of 2011 is filed by the 1st defendant to the
suit, Mr. Dilip Nevatia, who seeks that an earlier order dated 28th June 1996,
by which the 1st defendant was restrained from using the ground and first floor
of the property in question, be vacated. This is a matter best decided at the

hearing of the suit and the counter-claim, since the relief sought in the suit and
in the counter-claim will affect the question of whether the 1st defendant and
his wife are entitled to use the ground and first floor as they claim. Therefore,
this notice of motion is also adjourned to the hearing of the suit.
2.Notice of Motion No. 727 of 2012 filed by the plaintiffs is inter alia for
an injunction restraining the 1st and 2nd defendants from using the ground and
first floors of the property in question, is also pending. For the same reason, it
is also adjourned to the hearing of the suit.
