This Notice of Motion is taken out by Defendant Nos.1 to 6 for directions to the Prothonotary and Senior Master of this Court to lodge a proper complaint or in the alternative conduct an inquiry into the genuineness of the transport receipt relied upon by the Plaintiffs in their pleadings. This issue, in fact, can be gone into at the trial and may not be decided at this stage.
2 Learned Counsel for Defendant Nos.1 to 6 seeks leave to withdraw the Notice of Motion with liberty to raise this issue at the trial of the suit.
