claimed by the Plaintiffs that in pursuance of the suit agreement for sale, the Plaintiffs opened a bank account with the State Bank of India, Dadar Branch, where the Defendants had their own account. This was with a view to facilitate the payment of the purchase amount to the Defendants, in terms of the alleged agreement for sale. It is claimed by the Plaintiffs that the Plaintiffs deposited the entire sum of Rs.2.40 crores into their own account at State Bank of India, Dadar Branch, opened as aforesaid. It is then claimed that on the same date as deposit of the amount, the Defendants through their Advocate forwarded drafts of the agreement for sale and power of attorney to be executed by the Defendants in favour of the Plaintiffs. It is also claimed that on the same date, the Plaintiffs took out a pay order in the sum of Rs.11 lacs in favour of Sub-Registrar of Assurances and a pay order of Rs.30,000/- in favour of Joint Sub-Registrar Assurances towards payment of stamp duty and registration charges, respectively, in respect of the agreement for sale to be lodged for registration. The Plaintiffs, thereafter, claim to have issued two cheques respectively, of sums of Rs.1.50 crores and Rs.90 lacs on 26 April 2008 and 28 April 2008. It is claimed that these cheques have been returned by the Advocate of the Defendants. Thereafter, the present suit has been filed.
