1.This notice of motion is listed for hearing and final disposal.
Ad-interim reliefs were applied for and refused on 25th February
2013. Since then the suit has been completely readied for trial. Both
sides have filed their affidavits of documents. The plaintiffs have
also filed their affidavit of evidence. It only remains to have the
documents marked, and the trial can then immediately proceed.
Little purpose will be achieved in deciding the notice of motion at
this stage finally when the suit itself can be taken up within the next

few weeks. Indeed, a final order on the notice of motion may itself
delay the trial of the suit.
2.For that reason, list the suit for marking of documents on 1st
July 2014. Suit to be listed on the supplementary board on that day.
The plaintiffs must keep their witness present at 3.00 p.m. on the
very same day when cross-examination of the plaintiffs’ witness will
commence in Court.
3.In view thereof, no order is necessary on the notice of motion
and the same is disposed of as such.
