Heard learned counsel for the applicant. Perused the application. Learned counsel for the applicant-wife submits that, the applicant is residing at Ahmednagar along with her old aged parents, and due to matrimonial disputes, she has filed petition under The Protection of Women under Domestic Violence Act, at Ahmednagar. The respondent-husband has appeared in the said matter at Ahmednagar. The learned counsel states that, the respondent has filed a petition for divorce bearing Marriage Petition No.447/2013 before the Civil Judge, Senior Division, Pune. The learned counsel submits that,

the applicant is the only daughter of her parents and there is nobody in the family to help her to attend the Court at Pune and it would be difficult for her to travel from Ahmednagar to Pune for attending the Court case. He submits that, looking to the age of the applicant, it would not be convenient for her to travel alone from Ahmednagar to Pune.

The respondent is reported to have been served with notice. He is not present. Considering the submissions made and the contents of the application and also considering that convenience of wife needs to be kept in view, the application is allowed.

The proceedings of Marriage Petition No.447/2013 between the parties, pending before the Civil Judge, Senior Division, Pune are transferred to the Court of Civil Judge, Senior Division, Ahmednagar for decision according to law. Application stands disposed of.
